Hire terms

Version rent-terms-v2-2026-10-28. Why Not Ownit Pty Ltd trading as Why Not Drive, ABN 17 702 872 946

Who you are hiring from

Why Not Ownit Pty Ltd trading as Why Not Drive, ABN 17 702 872 946. In these terms "we" and "us" means Why Not Drive and "you" means the main driver named in this agreement.

Our depot is 31-33 Brolga Avenue, Southport QLD 4215, open 8 am to 6 pm, seven days.

These terms summarise, and are governed by, our Rental Terms and Conditions, Fees Schedule and Booking and Cancellation Policy at whynotdrive.com.au/rental-terms. If the two differ, the full documents apply.

The car

You are booking a class of car, not a particular model. The models shown are examples and you get one of them or a similar car in the same class. We tell you the car and its registration at pickup.

We check the car before every hire. You will be asked to photograph it at pickup and return, and those photos are how we compare its condition.

Hire period

The hire starts and ends at the times in this agreement. A hire day is 24 hours. A return up to 59 minutes late is free; after that each extra day, or part of a day, is charged at the daily rate for that date.

To extend, use your booking page or call us before the return time. An extension depends on the car being available and is re quoted at the price on the day you ask.

Who can drive

Only drivers named in this agreement can drive the car. Every driver must be 21 or over, hold an open (full) Australian driver licence that has been held for 12 consecutive months and is valid for the whole hire, and carry it while driving. Learner and provisional licences cannot drive the car. Drivers of our larger classes (People movers) need to be 25 or over.

Drivers under 25 pay a young driver fee of $16.50 a day, charged for at most 7 days in each 30 day period, shown in the price breakdown.

An additional driver costs $5 a day, capped at $25 for each driver in each 30 day period, and must meet the same rules.

What the price includes

The hire price includes registration and compulsory third party insurance. Damage to the car or another vehicle is covered by our arrangements subject to the excess below.

Fuel, tolls, fines, parking and any extras you choose are not included in the hire price. Optional extras are listed separately in the price breakdown.

Fuel, tolls and fines

Return the car with the same fuel level it had at pickup. If it is lower, we charge the litres needed at the pump price plus a refuelling fee of $30.

Tolls are passed on to you at cost plus $3.30 for each day a toll road is used (Linkt). If a fine or infringement is issued during your hire, we nominate you as the driver, you pay any fine that cannot be transferred, and an administration fee of $44 applies for each notice.

Excess

If the car is damaged, stolen or written off during your hire, you pay up to the excess for each event: $5,900 for our standard classes and $6,900 for our larger classes, unless you chose Excess Reduction or Zero Excess.

If another party is at fault and we recover the cost from them, we refund what you paid towards it.

Excess Reduction and Zero Excess

Excess Reduction is an optional daily extra that reduces your excess to $1,500 ($2,500 for our larger classes). Zero Excess reduces it to $0. Both are promises in this agreement sold by Why Not Drive, not insurance, and the daily price is shown in the price breakdown.

Neither applies to damage caused while the car is driven by someone not named in this agreement, while a driver is affected by alcohol or drugs, in breach of these terms, or deliberately. In those cases the standard excess and the costs of the damage can apply.

Bond

When you pay, we place a hold on your card for the bond: $200 for our standard classes and $500 for our larger classes. If your usual address is within about 100 km of our depot the bond is $1,000, or $500 with Zero Excess. A hold is not a charge. For pickups more than 5 days away, we place the hold the day before pickup.

We release the hold within 1 business day after the car is returned and checked. If you owe us money under this agreement, such as the excess, fuel, tolls, fines or cleaning beyond normal use, we may take that amount from the hold. We send you an itemised account with the photos or documents behind every amount, and you have 7 business days to query it.

Changes and cancellations

You can change your dates or cancel on your booking page. If you cancel 24 hours or more before pickup, we refund what you paid in full. If you cancel later than that, we keep the first day's hire and refund the rest. If you do not collect the car within 2 hours of the pickup time and we cannot reach you, the booking is treated as cancelled late.

Changing dates re quotes the booking. If the new price is higher you pay the difference; if it is lower we refund the difference.

If we cannot provide a car for your booking, we refund everything you paid.

Using the car

Drive the car on sealed roads in Queensland and northern New South Wales unless we agree otherwise in writing. Do not tow, race, carry more people than seats, smoke or vape in the car, or use it for rideshare, delivery or other paid driving unless we agree in writing.

Return the car as clean as you received it. Cleaning beyond normal use is charged at actual cost ($110 as a guide).

Lock the car and keep the keys safe. Tell us straight away if the car is damaged, breaks down, shows a warning light or is stolen.

Tracking

The car is fitted with a GPS tracker. We use it to find the car, protect it from theft and confirm where it is at the end of the hire. If the car is not returned on time and we cannot reach you, or it is reported stolen, we may stop it from starting once it is stationary.

Accidents and breakdowns

If there is an accident, make sure everyone is safe, call 000 if anyone is hurt, swap details with the other driver, take photos and call us. Report it to police where the law requires.

If the car breaks down through no fault of yours, we arrange help and, where we can, a replacement car.

Hotel delivery

If you chose hotel delivery, we leave the keys with the hotel concierge in your name. The concierge gives you the keys when you show the handover code we send you after your identity check and payment. You are responsible for the car from when you collect the keys until you hand them back to the concierge or to us at the return time.

Your personal information

We collect your details to manage this hire, check your identity and licence, and meet our legal obligations. We handle them as our privacy policy at whynotdrive.com.au/privacy explains.

Your rights

Nothing in this agreement excludes, restricts or changes any right or remedy you have under the Australian Consumer Law. To make a complaint, see whynotdrive.com.au/complaints or call us.

Signing electronically

You accept this agreement electronically. We record the time, your IP address, the name you typed and a fingerprint (SHA-256 hash) of this exact document, and email you a copy.
